NOTICE OF FORECLOSURE SALE OF REAL ESTATE
On August 8, 2006, by Deed of Trust placed of record on August 16, 2006 at 9:25 a.m., in Record Book 1198, Page 1736, in the office of the Register of Deeds for Wilson County, Tennessee (the "Deed of Trust"), Chad Farley (the "Mortgagor") conveyed to Jonathan R. Vinson, Trustee, (the "Trustee") the hereinafter described real estate, to secure the payment of a promissory note as described therein (the "Note"), payable to the order of F&M Bank f/k/a Farmers and Merchants Bank (the "Holder"):
The Deed of Trust provided that in the event of default in the payment of the Note, when due, then the entire balance of the Note shall, at the option of the Holder, become due and payable immediately; and,
Default having been made and continued in the payment of the Note, the Holder of the Note, has declared the entire balance of the Note due and payable as provided in the Deed of Trust. NOW, THEREFORE, by virtue of the authority vested in the Trustee under the Deed of Trust, the Trustee will, on Thursday, September 16, 2010 at 2:00 p.m., prevailing time, offer for sale and sell at the front door of the Wilson County Courthouse, Lebanon, Tennessee, to the highest and best bidder for cash, and in bar of the rights of redemption, homestead and all other exemptions of every kind which the Mortgagor of the Deed of Trust or anyone claiming under or through the Mortgagor may have, all such rights and equities having been expressly waived in the Deed of Trust, the following described real estate situated in Wilson County, Tennessee, to-wit:

BEING the same property conveyed to Chad Farley by Warranty Deed from Benjamin Stacey and James Sean Sadler dated August 8, 2006 and filed of record in Book 1198, Page 1734, Register s Office for Wilson County, Tennessee.
Included in the above described description, but expressly excluded therefrom is the following described tract or parcel of land, described as follows, to-wit:
Land in Wilson County, Tennessee, and being Lot No. 1 on the plan of Robert Darnall Bennett and Darlene Bennett Eley Property as shown of record in Plat Book 25, Page 917, Register s Office for Wilson County, Tennessee, to which plat reference is hereby made for a more complete description of said property.
BEING a portion of the same property conveyed to Benjamin Stacey and James Sean Sadler by Warranty Deed from David Ewen and wife, Kayron Ewen, dated July 14, 2006 and filed of record in Book 1192, Page 536 and being the same property previously conveyed to David Ewen and wife, Kayron Ewen by Warranty Deed from Robert Darnall (Don) Bennett and Darlene Bennett Eley, Co-Trustees of the Ova Mai Bennett Trust, established under the Will of Thomas Franklin Bennett, and Ova Mai Bennett, unmarried, individually, dated November 24, 2003 and filed of record in Book 1023, Page 1353, Register s Office for Wilson County, Tennessee.
